Definitions

Customer: any competent professional or person within the meaning of Articles 1123 and following of the Civil Code, or legal person, who visits the website subject to these general conditions.
Services: adhel.fr provides Customers with:

6. Limitations of Liability

Anne Doré acts as the editor of adhel.fr and is responsible for the quality and veracity of the content she publishes.
Anne Doré shall not be liable for any direct or indirect damage caused to the user’s material, when accessing the adhel.fr website, and resulting either from the use of material that does not meet the specifications indicated in point 4, or the appearance of a bug or incompatibility.
Anne Doré cannot be held liable for indirect damages (such as a loss of market or chance) resulting from the use of adhel.fr. Interactive spaces (possibility to ask questions in the contact area) are available to users. adhel.fr reserves the right to delete, without prior notice, any content deposited in this space that would contravene the legislation applicable in France, in particular the provisions relating to data protection.

7. Personal Data Management

The Customer is informed of the regulations concerning marketing communication, the law of 21 June 2014 for trust in the Digital Economy, the Data Protection Act of 06 August 2004 and the General Regulation on Data Protection (GDPR: no. 2016-679).

7.1 Persons responsible for the collection of personal data

For Personal Data collected in the context of the creation of the User’s personal account and his navigation on the Site, the person responsible for the processing of Personal Data is Mrs Anne Doré. adhel.fr is represented by Anne Doré, its legal representative.
As the controller of the data it collects, adhel.fr undertakes to comply with the legal provisions in force. It is the Customer’s responsibility, in particular, to establish the purposes of its data processing, to provide its prospects and customers, from the collection of their consents, complete information on the processing of their personal data and maintain a register of processing in line with reality. Whenever adhel.fr processes Personal Data, adhel.fr takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which adhel.fr processes them.

7.2 Purpose of the data collected

adhel.fr may process all or part of the data:

  • to enable navigation on the Website and the management and traceability of services ordered by the user: login and use data of the Website, etc.

As soon as adhel.fr becomes aware of the death of a User and in the absence of instructions from it, adhel.fr undertakes to destroy its data, unless their retention is necessary for probationary purposes or to meet a legal obligation.

in this case, the User must indicate the Personal Data that he would like adhel.fr to correct, update or delete, identifying himself precisely with a copy of an identity document (identity card or passport).
Requests for deletion of Personal Data will be subject to the obligations imposed on adhel.fr by law, in particular as regards the preservation or archiving of documents. 7.4 Non-communication of personal data

adhel.fr forbids itself from processing, hosting or transferring the Information collected on its Customers to a country located outside the European Union or recognized as «inadequate» by the European Commission without informing the customer beforehand. However, adhel.fr remains free to choose its technical and commercial subcontractors on the condition that it provides sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: no. 2016-679).
adhel.fr undertakes to take all necessary precautions to preserve the security of the Information and in particular that it is not communicated to unauthorised persons.However, if an incident affecting the integrity or confidentiality of the Customer’s Information is brought to the attention of adhel.fr, the latter must inform the Customer as soon as possible and inform him of the corrective measures taken. Moreover adhel.fr does not collect any «sensitive data».
The User’s Personal Data may be processed by adhel.fr subsidiaries and subcontractors (service providers), exclusively in order to achieve the purposes of this policy.

8. Incident Notification

Whatever efforts are made, no method of transmission over the Internet and no method of electronic storage is completely secure. We cannot therefore guarantee absolute security. If we became aware of a security breach, we would notify the affected users so that they could take appropriate action. Our incident notification procedures take into account our legal obligations, whether at national or European level. We are committed to fully informing our customers of all matters relating to the security of their accounts and to providing them with all the information necessary to help them comply with their own regulatory reporting obligations.

10.1. Cookies

11. Applicable law and jurisdiction

Any dispute relating to the use of adhel.fr is subject to French law. Except in cases where the law does not permit it, exclusive jurisdiction is conferred on the competent courts.
